Dear Colleagues,

After intensive consultations and further to the decisions of both Executive Committees ECF and EFA will be founding on 11 December 2000 a new European trade union federation, EFFAT, that will cover the sectors of Agriculture, Food and Tobacco as well as Hotel, Restaurant and Catering.

We are pleased to invite you to the (Vth) extraordinary Regional Conference of ECF-IUF which will be held in Luxembourg, in the morning of 11 December 2000 and to the foundation of the new European Federation EFFAT in the afternoon of 11 December 2000.

A discussion on the future of the Social Dialogue and further political challenges that are important for us is scheduled for the 12th of December.

According to our circular n° 14/2000 dated April 3 you were requested to start arranging your hotel accommodation yourselves for your delegates.

Interpretation facilities will be provided in following languages: English, German, French, Italian, Spanish, Danish, Finnish and Dutch – passive Swedish, Norwegian and Portuguese.

Please find enclosed herewith documents which were in principle adopted by the Executive Committee on 26-27 June 2000 and so it was also regarding proposals for

-Agendas of the dissolution and the foundation congresses
-the rules of procedure for the extraordinary Regional Conference of ECF-IUF
-the voting rights of the member organisations for the dissolution and foundation congresses.

We kindly request you to inform us on the names of your delegates by 16 November 2000 latest on enclosed enrolment form (see enclosed distribution key). To comply with our political objectives please look for a balanced representation of male and female delegates when the latter are appointed. Please refer to Article IV, l.A.of the ECF Constitution in particular.

            INTERNAL RULES OF PROCEDURE(draft)

            For the (Vth) extraordinary Regional Conference of ECF-IUF
            (Luxembourg, 11 December, 2000)

            l.The sessions shall commence at the appointed time, irrespective of the number of delegates present. Any changes in timetable can only be made if decided by the Regional Conference.

            2.The praesidium of the Regional Conference shall be composed of the ECF-IUF President and General Secretary, as well as three further Vice-presidents.

            3.The Credentials Committee shall be composed of 3 delegates who shall be nominated by the Executive Committee and have to be appointed by the Regional Conference. The Conference shall decide on the validity of the voting rights of the member organisations represented at the Conference after hearing the report of the Credentials Committee. The voting rights fall to the whole delegation of the organisation, i.e. it is possible to delegate one’s voting right within the delegation. The Credentials Committee shall also act as Election Committee and Teller Committee.

            4.The official working languages of the Regional Conference shall be German, English, French, Dutch, Italian, Spanish, Finnish and Danish (passive languages: Swedish, Norwegian, Portuguese) as well as ECE languages. Any delegate wishing to express himself or herself in a language other than these working languages may – if necessary – be accompanied by an interpreter who is approved by the president of the Conference and who translates the delegate’s statements into one of the official languages.

            5.Requests for leave to speak shall not be accepted until the debate has been opened; they must be presented to the praesidium in writing and the name and organisation of the delegate in question must be indicated as well as the subject he/she wants to talk on.

            6.Permission to speak on points of order shall be granted out of order as regards the listed speakers, but at the end of each address or contribution to the discussion or translation. Requests for leave to speak must not interrupt the speaker while he/she is speaking or the translation of his/her statements. If a request is made to speak on the rules of procedure, there can only be a speaker for and one against.

            7.The president of the congress may grant permission to speak to the ECF president and general secretary at any time out of order regarding the list of speakers.

            8.The Resolutions Committee is composed of the president and the general secretary as well as 4 further members of the ECF-IUF Management Committee. It has to be confirmed by the Regional Conference.

            9.Motions and resolutions and also proposals for amendments to the draft constitution of the new EF to be founded must be submitted to the secretariat by 12.9.2000 (postmark).

            The delegates to the Regional Conference shall decide upon the recommendation of the Resolutions Committee how further emergency issues, that have to be submitted to the ECF-IUF secretariat by 30.11.2000 latest, are to be dealt with. These shall be motions which are submitted on the basis of events occurring after the 12.9.2000 and requiring a decision by the ECF-IUF Regional Conference.

            10.When a motion is being dealt with, the spokesman of the Resolutions Committee shall first take the floor, after which the spokesman of the organisation tabling the motion shall be allowed to speak. When the motions are put to the vote, a vote shall first be held on the recommendation of the Resolutions Committee. Should that recommendation fail to obtain a majority, the motions shall be dealt with in the order in which they have been debated.

            11.Applications to the positions of president and general secretary in the new EF and presidents and secretaries of the sectors as well as the presidents of the Women’s and Youth Committees of the new EF to be founded, have to be submitted to the secretariats by 3.10.2000 latest.

            12.Each speaker shall be allowed to take the floor for a maximum of 5 minutes; where circumstances require further restriction of the number of speakers or of the time they are allowed, a decision may be taken to that effect.

            13.The discussion on any item under debate may be concluded through the approval of a "motion to end the debate" tabled by any delegate.

            Neither the person tabling a motion nor those who have spoken on that motion may table a motion to close the debate or the list of speakers.

            14..Personal comments on a subject under discussion shall be allowed at the end of the debate.

            15.Should a speaker fail to keep to the point, the President of the Conference must call him/her to order. When the President of the Conference has warned the speaker twice to no avail, the leave to speak shall be withdrawn.

            16.The voting procedure regarding motions and resolutions shall be carried out with the absolute majority of the votes recorded. Amendments to the constitution require a 2/3 majority of the Regional Conference.

            17.The Regional Conference shall constitute a quorum when more than half of the delegates of the organisations represented who are entitled to vote are present.

            When the decision-making bodies are elected and when a majority of the delegates entitled to vote cannot be reached, a second ballot is held after which the proposal with the most valid votes is adopted. A further ballot is held in case of an equal number of votes.

            If only one single candidature has been submitted, the vote take can place by show of hands. Election by secret vote is carried out when a delegate makes a written request for.
